The U.S. Small Business Administration has released a single-page form aimed at simplifying the process of applying for forgiveness of Paycheck Protection Program loans, together with updated and revised forms that meet the requirements of the latest stimulus legislation. 

Congress approved the COVID-19 relief package in the month of March that provided $284 billion of funding to small businesses in need of loans. This money was used to mitigate the economic effects of the coronavirus pandemic. The law required that the SBA issue simplified forms within 24 hours of the legislation’s signing into law. This was done to facilitate the application for forgiveness. It also included conditions that would encourage community banks to make more loans, especially to minority-owned businesses who had a difficult time getting loans last year.

Forgiveness terms for the initial draw of PPP loans

  • It’s the same for compensation and employees.
  • The loan proceeds can be used to cover expenses for payroll or other eligible expenses.
  • A minimum of 60% of the profits are spent on payroll costs

Second Draw PPP Conditions for loan forgiveness

Second Draw PPP loans made to borrowers who meet the criteria are eligible for complete loan forgiveness, if within the 8– to 24-week time period after loan disbursement:

  • The levels of compensation and employee pay are maintained in the same way as is required for the First Draw PPP loan
  • The loan proceeds are used on payroll expenses and other expenses that are eligible and
  • At least 60% of the profits are used for the cost of payroll

The borrower is eligible for forgiveness only after the loan’s proceeds for which the borrower is requesting forgiveness have been used. The borrower can apply for forgiveness at any time until the date of maturity. If the borrower does not apply for forgiveness within 10 months of the last day of the period covered and the loan is not renewed, PPP loan payments can no longer deferred and borrowers will begin making monthly payments to their PPP lender.
