State Student Loan Forgiveness

The U.S. Small Business Administration has issued a one-page form that simplifies the application for the cancellation of Paycheck Protection Program loans. The form is also updated with new forms that are in line with the current stimulus law. 

Congress approved the COVID-19 relief package in the month of March and offered $284 billion in funding for small-scale businesses who needed loans. This money was used to mitigate the economic effects of the coronavirus epidemic. The law required that the SBA provide simplified forms within 24 hours of the signing into law. This was to facilitate the application for forgiveness. The legislation also contained conditions that would encourage community banks to lend more particularly to minority-owned businesses that had difficulty getting loans last year.

Ed Zollars, a partner with Thomas, Zollars & Lynch CPAs said that the Small Business Administration fulfilled the obligation to issue the one-page PPP form loan forgiveness within the first 24 hours of the date of enactment in the Consolidated Appropriations Act, 20,21. This was published on the Current Federal Tax Developments blog of Kaplan Financial Education. “The agency also issued the updated forms.”

Forgiveness terms in the first draw of PPP loans

State Student Loan Forgiveness – For eligible borrowers First Draw PPP loans can be eligible to be forgiven. This happens when the loan is disbursed within an 8 to 24-week timeframe.

  • The levels of compensation and employee pay are ensured
  • The loan proceeds are used on payroll as well as other expenses eligible for reimbursement; and
  • At least 60% of the proceeds are used for the cost of payroll

Second Draw PPP Loan Forgiveness Terms

Second Draw PPP loans for eligible customers are eligible for loan forgiveness when the loan is repaid within an 8– to 24-week period.

  • Pay and worker levels are maintained in the same way as is required for the First Draw PPP loan
  • The loan proceeds are used on payroll as well as other eligible expenses and
  • At least 60% of profits are used to pay for payroll expenses
  • How to request loan forgiveness and the time to apply

Once all of the loan’s proceeds have been used, a borrower can apply to be forgiven. Borrowers can request forgiveness at any point up to the date at which the loan matures. Borrowers who do not request forgiveness within 10 months after the date they will be able to repay the loan are able to receive payment from their PPP lender.
