The U.S. Small Business Administration has released a form of one page that makes it easier to apply for the cancellation of Paycheck Protection Program loans. It also includes newly revised forms to comply with the most recent stimulus law. 

The COVID-19 relief plan that Congress approved last month renewed the PPP with $284 billion in funds for small businesses that want forgivable loans to help them deal with the financial fallout from the coronavirus outbreak. The law requires that the SBA issue simplified forms within the first 24 hours of the legislation’s signing into law. This was done to facilitate the application for forgiveness. The legislation also contained conditions that would encourage banks in the community to lend more specifically to minority-owned companies who were unable to obtain loans last year.

“The Small Business Administration met the requirements to release the one page form for loan forgiveness under the PPP by 24 days after the date of enactment of the Consolidated Appropriations Act, 2021,” wrote Ed Zollars, a partner at Thomas, Zollars & Lynch CPAs on his Current Federal Tax Developments blog for Kaplan Financial Education. “The agency also released new forms that were updated.”

First Draw PPP Loan forgiveness terms

Hbcu Loan Forgiveness – First Draw PPP loans granted to borrowers who are eligible can be granted complete loan forgiveness if they do so within the 8-to 24 week period that follows the disbursement of loan:

  • Pay and worker levels are maintained
  • The loan proceeds are used on payroll expenses and other eligible expenses; and
  • At least 60% of funds go to the cost of payroll

Second Draw PPP Loan Forgiveness Conditions

Second Draw PPP loans granted to borrowers who meet the criteria are eligible for full loan forgiveness if during the 8– to 24-week time period after the loan’s disbursement

  • The First Draw PPP loan requires that the compensation and employee levels be maintained in an identical manner.
  • The loan funds could be used to cover payroll costs or other expenses that are eligible.
  • A minimum of 60% of proceeds are used to pay for payroll expenses
  • How and when to apply for loan forgiveness

A borrower may apply for forgiveness once all loan proceeds to which the borrower is requesting forgiveness have been used. The borrower can apply for forgiveness at any time until the loan’s maturity date. If the borrower does not apply for forgiveness within 10 years of the end of the time period that was covered the PPP loans are no longer deferred, and borrowers will begin making payment to their PPP lender.
