The U.S. Small Business Administration released a one-page form aimed at simplifying the process of applying for the forgiveness of Paycheck Protection Program loans, as well as newly revised and updated forms to comply with the latest stimulus legislation. 

The COVID-19 relief package that Congress approved last month renewed the PPP with $284 billion in funding for small businesses seeking forgivable loans to help them deal with the financial fallout from the coronavirus outbreak. The law required that the SBA issue simplified forms within the first 24 hours of the legislation’s signing into law. This was to make it easier to apply for forgiveness. The legislation also contained conditions that would encourage community banks to lend more particularly to minority-owned businesses who were unable to obtain loans in the past.

Ed Zollars, a partner with Thomas, Zollars & Lynch CPAs, stated that the Small Business Administration fulfilled the requirement to publish the one-page form for PPP loan forgiveness within the first 24 hours from the date of enactment under the Consolidated Appropriations Act, 20,21. This was on the Current Federal Tax Developments blog of Kaplan Financial Education. “The agency also issued new forms that were updated.”

Forgiveness terms in the first draw of PPP loans

Direct Student Loan Forgiveness Teachers – For borrowers who are eligible, First Draw PPP loans are suitable for loan forgiveness. This applies when the loan is disbursed within an 8 to 24-week timeframe.

  • Pay and worker levels are ensured
  • The loan proceeds are spent on payroll costs and other expenses that are eligible and
  • At least 60% of proceeds are spent on payroll costs

Second Draw PPP Loan Forgiveness The terms

Second Draw PPP loans to qualified customers are eligible for loan repayment if the loan is paid within an 8to 24-week time frame.

  • The levels of compensation and employee pay are maintained in the same way as is required for the First Draw PPP loan
  • The loan funds are used on payroll costs and other expenses that are eligible and
  • At least 60% of funds go to the cost of payroll
  • How do I request loan forgiveness and when to apply

The borrower is eligible for forgiveness after all loan proceeds to which the borrower has applied for forgiveness have been used. The borrower can request forgiveness any time up until the date of maturity of the loan. If the borrower does not apply for forgiveness within 10 months of the end of the period covered, then PPP loan payments are not deferred any longer, and borrowers must make payment to their PPP lender.
